Terms of Service

1. A game in development

Everything on this site describes a game that is still being made. Features, art, story, platforms, prices and dates can change, slip or be cut, and some may never ship. Concept art and target renders are not gameplay footage.

Nothing on the site is an offer to sell you anything. Joining the wishlist doesn't reserve a copy, buy you anything, or guarantee you a place in a playtest.

2. The wishlist

When you join the wishlist, you're asking us to email you about Forsunken: the trailer, playtests, the launch and other major news. To join, you must be at least 16 and use an email address that belongs to you. Please don't sign anyone else up.

You can leave at any time with the unsubscribe link in any email we send, or by writing to crew@forsunken.com. We may remove addresses that bounce or look like abuse. Our Privacy Policy explains how we handle your address.

3. Using the site

Use the site for what it's for: reading about Forsunken and getting in touch. You agree not to:

• attack, probe, overload or try to break the site or the servers it runs on;
• scrape content or data in bulk, or sign up addresses automatically;
• use the site for anything unlawful, or to send spam or malware;
• pretend to be the Forsunken team, or anyone else.

We may block access, or delete wishlist entries, that break these rules.

4. Our content

The Forsunken name and logo, the artwork, the writing, the code and everything else on the site belong to us or to the people we license them from. You're welcome to look, share links, and post screenshots of the site with credit, as long as it isn't for commercial purposes.

Press, streamers and creators may use the materials in the press kit (logos, key art, screenshots, the boilerplate and the fact sheet) to write about, review or cover Forsunken, provided you don't alter them in a misleading way or suggest that we endorse you. For anything else, ask us first at press@forsunken.com.

5. Ideas and feedback

We like hearing from players. If you send us ideas, suggestions or feedback, you agree that we may use them to make the game without owing you anything, and that sending them doesn't put us under any obligation. Please don't send us anything you need kept confidential.

6. Other services

The site links to services we don't run, such as Discord, YouTube and Vimeo. Their own terms and privacy policies apply when you use them, and we aren't responsible for their content or for how they handle your data. Our Discord server has its own rules, posted there.

7. No guarantees

We work hard on the site, but we provide it "as is" and "as available". To the extent the law allows, we don't promise that it will always be online, that it will be free of errors, or that everything on it is complete or current, and we disclaim implied warranties, including fitness for a particular purpose and non-infringement.

8. Limits on our liability

To the extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data, arising from your use of the site or your inability to use it. Our total liability for any claim connected with the site is limited to 50 US dollars.

Nothing in these terms limits liability that the law doesn't allow us to limit, such as liability for fraud, or for death or personal injury caused by negligence. If you live somewhere that gives you consumer rights these terms can't override, you keep those rights.

9. Changes to these terms

We may update these terms as the game and the site change. The date at the top shows the current version. If a change is significant, we'll point it out on the site, and tell wishlist members by email when it affects them. If you keep using the site after a change takes effect, the new terms apply.

10. Ending things

You can stop using the site and leave the wishlist whenever you like. We can change, pause or close the site or the wishlist at any time.

11. The law that applies

These terms are governed by the laws of the country where the Forsunken team is established, without regard to its conflict-of-law rules. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts.
